MAGA update: MAGA's two-tiered law system

Mother Jones writes about the collapse of the USSC as a pro-democracy institution and its reincarnation as a major source of power driving the rise of a kleptocratic American dictatorship. In a lawsuit filed last January days after Trump signed an EO that denied birthright citizenship, the USSC completely side stepped the issue. Instead, it gutted all of the power that federal judges had to issue nationwide injunctions against illegal actions by Trump and MAGA elites. That decision was out of the blue. Birthright citizenship is clearly specified in the constitution, so Trump's EO was equally clearly unconstitutional.

In her dissent, judge Jackson accused the majority of establishing a two-tiered justice system: One was for the dictator and often wealthy or powerful elite allies. The other was for people targeted by the president’s illegal actions and whims. Jackson wrote: “The law-free zone that results from this Court’s near elimination of universal injunctions is not an unfamiliar archetype”. She called the decision “eerily echoing history’s horrors .... the zone of lawlessness the majority has now authorized will disproportionately impact the poor, the uneducated, and the unpopular.”

In her dissent, Jackson included a footnote citing Ernst Fraenkel, a Jewish labor lawyer who chronicled the transformation of the German legal system under Hitler. Fraenkel escaped Germany, came to the US and published a book in 1941, The Dual State: A Contribution to the Theory of Dictatorship. Long article summarized: A dictator like Hitler exercised unfettered power while life for most ordinary people are usually unaffected. Jackson commented that a “zone of lawlessness” like what the USSC created will swallow targeted people, leaving the rest to go about their normal lives and subject to laws. In other words, Hitler was above the law and did what he wanted whether it was legal or not. 

The most important injection of vitality into the dictator's two-tiered system was the MAGA USSC's 2024 decision in Trump v. US that immunized presidents (i.e., Trump) against prosecution for crimes he commits while in office. When coupled with unlimited presidential pardon power, we clearly have two-tied system of law. So here we have yet another non-trivial parallel between Trump and Hitler.

Q: About what % of voters generally, MAGA-Trump voters, and people in the MSM are solidly aware of how much wealth and power, especially institutional capture and subversion, has been transferred from average citizens to MAGA's corrupt authoritarianism, Trump and MAGA elites?*

They do not sense the vast flow of wealth and power from themselves to MAGA-allied elites. And, the MSM does F-level (failing) work in informing the public. Some of the few people who see the danger, but are socially or economically trapped and powerless to oppose. Plenty of evidence in the public record supports all of those assertions. .... Ignorance of how much wealth and power we have lost and how much more we will lose is literally killing us and our democracy, rule of law and civil liberties.

The uninitiated might mistake him for a loafer or, if feeling generous, a Zen dropout reincarnated in corporate America. “I’m a rest in the music of business,” he clarifies, beaming. “Imagine music with no silence—just notes, notes, notes. Insufferable, right? That’s your modern office: motion without meaning. I just introduce a pause.”

A pause, it turns out, can yield miracles. “People are always on ten, amped up, itching to go. Eventually, you burn out. You need to learn how to really chill. If you can’t, you bring in someone like me. Someone who can chill for you.” He claps me on the shoulder, like the world’s friendliest sedative.

This is not, he asserts, mere passivity. “It’s not just doing nothing,” he insists with an air of reversed gravitas. “It’s doing nothing at the right time, in the right place, to create a breathing space for the corporation. You need someone to disrupt the momentum—not with action, but with stillness!”

He calls it “reverse cognitive jujitsu.” In regular jujitsu, he explains, you use an opponent’s energy to bring them down. “In reverse jujitsu, you use whatever energy people have left to lift them back up. They’re already down—creatively, mentally, emotionally. I get them standing again. Sometimes, by doing less than nothing at all.”

His techniques are as subtle as they are questionably HR-compliant. “I once noticed two colleagues about to clash like cats and dogs. I simply wandered over and pulled up a chair between them—purely ‘by accident,’ of course—and sat there, blocking the reengagement. At first, they were annoyed, but then, having broken their flow, they lost interest in the quarrel. Pretty soon, chaos was replaced by an awkward peace.”

Then there was the time he sabotaged a photocopier at a moment of peak workplace distress. “A woman was cursing, about to blow a gasket. So I jammed the paper tray. She was forced to take a break. By the time maintenance fixed it, she’d calmed down completely. Sometimes salvation is a paper jam.”

He is, in his own estimation, a cross between a “corporate therapist” and “human speed bump”—a master of strategic nothingness. “I just shake things up—by not shaking at all.”

Rising to the Top by Lying Down Flat

Don’t confuse him with a slacker. “To do nothing well requires tremendous effort. You must project busyness at all times. There’s method acting involved. When not offering his high-level “services” to one corporate ecosystem, he moves to another, leaving no trace—except, perhaps, a temporary lull in the local chaos. “If I get found out, I just leave. New office, new pseudonym, same nothing. The beauty of my method is that it works everywhere and nowhere.”

The Last Word in Mindful Inaction

What, then, can today’s hyper-digitized, burnout-prone workplace learn from the maestro of doing nothing? “Introduce silence,” he says, “make space for spontaneity. Throw in a paper jam. Let things breathe. You might be amazed what bubbles to the surface.”

As our conversation ends, he offers me his card, the ink so faint you can barely read it unless you really squint. “‘Full-time chill,’” it says. “That tells you all you need to know.”

Project 2026 update: How to structure it?

My conception of and rationale for Project 2026 (P26) has not been abandoned. Writing it is a moral duty, at least from a pragmatic rationalist point of view. Only the preface is done so far. That bit remains open to suggestions & revisions. How to structure P26 and what to include and exclude has me in writer's block. The complexity is overwhelming. So to try to get unblocked, I asked Pxy for advice/commentary (Comet, actually -- aggressive AI is needed for this task). Talking to Pxy is close to thinking out loud.

How a pragmatic rationalist does day-to-day politics

It is clear that my political ideology, pragmatic rationalism (PR), an anti-biasing, anti-ideology meta-ideology, is a rare outlier among human mindsets. The PR meta-ideology is anti-biasing and anti-ideology based on modern cognitive biology and social behavior science, not any ideology. Hence the anti-biasing and anti-ideology labels. And hence the quote from Berger's 1963 book. Few people do politics with this kind of science-based mindset, maybe ~1%. 

A day in the PR life

What does average practice of PR look like? Here's an example. These days, inputs from email or news sources like the NYT, The Hill, reddit, etc., start AI-fueled deep dives into all sorts of things. The initial input triggers AI dives into details. Today is a good example. My daily reddit feed included this from r/skeptic, Jordan Peterson hospitalized with pneumonia and sepsis (SIRS), and ....: Apparently Peterson had mold in his house and it made him very sick.

Not knowing much about Jordan Peterson, Pxy got tasked with explaining who he is and why he is being talked about. The PR mind likes to ask things like, who in the hell is this person anyway and are they worth paying any attention to?

A1 (paraphrased): Long answer, with key points: He is a Canadian PhD, trained in Canada as a clinical psychologist. Taught at Harvard for a while. Went back to academia in Toronto. Somewhere along the line, he turned into some possibly mild to moderate version of an American MAGA ideologue who hates woke and DEI because they are tools of socialist oppression and evil, or something like that. He resigned from his tenured position at University of Toronto in 2021, presumably a regular retirement due to age.

Interestingly, his academic work focused on personality theory, combining psychology, mythology, religion, literature, philosophy, and neuroscience to analyze systems of belief and meaning. Based on that, his mindset could have veered into PR or some variant resembling it, but instead he took the cognitively fun and easy but not particularly rational way out. That's just like MAGA.

These days, that is a typical PR meta-ideology prompt and response sequence. It takes more time, effort and moral courage (facing reality even if it turns out to be inconvenient) than the fast, easy  morally bankrupt (not facing reality, especially when it turns out to be inconvenient) MAGA way.

Obviously, Pxy's assessment of ~22.5% valid and ~77.5% falsehood and propaganda is an estimate. From what I can tell, no one questions about what % of a person's rhetoric or ideology is falsehood and propaganda and about what % is more or less rational and principled difference of opinion. That is something academia appears not to think about. Or if it does, I'm unaware of the research. IMHO, that question is critically important for obvious reasons.
